Radon – FAQ

What is radon?
Radon is a radioactive, colorless, odorless, dense, tasteless noble gas, occurring naturally in soil.

How does radon get into homes?
Radon gas forms naturally in the soil in the Midwest. When the gas is produced, it simply rises up through the ground and is released into the natural environment.
However, when homes are built in or on soil emitting radon, instead of the gas rising up through dense soil, radon gas chooses the path of least resistance – normally through the floors or wall of the first level of the home – the basement. Depending on how the home was built and how ventilated the basement is, levels of radon can fluctuate.

Why is radon dangerous to human beings?
Radon has been classified as carcinogenic by the US EPA. Radon is the second leading cause of lung cancer – first being smoking. People who are exposed to both radon gas and smoke (first or second-hand) have a multipled risk of developing lung cancer.
Most radon-induced lung cancers occur from low and medium dose exposures in people’s homes.

Why are basements the most likely place to find radon gas? Why not in my second floor apartment?
Radon gas comes from decay of radioactive substances that are ubiquitous in the Midwestern soil. Because basements and first floor units are most often the first point of contact between soil (the source of radon gas) and the building, this is where radon normally enters the building.
Radon gas is also far more dense than “air.” Helium is lighter and less dense than air and therefore balloons filled with it fly away and up into the sky if not held down. Radon is heavier than air. For that reason, it sinks below lighter “air” to remain in our basements and lower level units. The more time someone spends in a unit/basement that has radon gas, the more exposure that person receives.

How do I know if my family and I are being exposed to radon gas?
If you live in the basement or first floor of a building, it is likely that you are being exposed to radon gas. The risk goes up if the building was poorly built, is poorly maintained and/or is poorly ventilated. There is no safe level of radon but minimizing exposure can reduce you and your family’s risk of lung cancer.
If you live in a second floor unit or higher, it is unlikely that you and your family are being exposed to significant levels of radon in your home.
The only way to know for sure is to test your living space(s).

Is there a test for radon?

Bed Bugs – FAQ

What are bed bugs?
Bed bugs are small, wingless insects that feed on the blood of warm-blooded animals. Bed bugs prefer human blood, but can also feed on pets if people aren’t present.

Are bed bugs disease carriers?
There isn’t any medical evidence that bed bugs pose any sort of health risk. Some people do, however, experience mild reactions to their bites. It is also possible for the bites to result in secondary infections if scratched.

How did I get bed bugs?
A bed bug infestation is not an indicator of a lack of cleanliness. Bed bugs feed on blood and are attracted to CO2. They may have hitchhiked onto your belongings and into your home or, if you live in a multi-unit building, they may have traveled from an adjacent unit.

So, there really isn’t any link between bed bugs and sanitation?
None. Bed bugs are not attracted to filth nor do they feed on it. However, reducing clutter is extremely important as clutter can provide hiding space for bed bugs. Bed bugs will thrive in cluttered environments because the effectiveness of your pest control plan will be limited.

I have a bed bug infestation. What do I do?
Around the House

-Reduce clutter in the home. These are safe havens for bed bugs.
-Vacuum frequently.
-Wash clothes in hot water and dry in high heat for a minimum of 20 minutes.
-Do not apply pesticides on your own. Applying pesticides should be left to licensed pest control professionals.
-Never use bug bombs or total release foggers. These can worsen the infestation and are extremely harmful to your health.

Beds and Furniture
-Steam clean your bed and other furniture at a heat of 120 degrees or more.
-Encase your mattress and box spring with bed bug proof mattress protectors.
-Do not apply pesticides to your bed or other furniture. Pesticides are often harmful to people.
-Do not throw away your furniture until a pest control professional tells you that it can’t be salvaged.
-If you must throw away your bed or other furniture, please dispose responsibly. Render the furniture unusable by slashing all sides or spray paint “bed bugs” in large letters.

Remember, bed bugs and their eggs absolutely cannot survive temperatures higher than 130 degrees Fahrenheit.

Is my landlord responsible for ridding my unit of bed bugs?
On June 5, 2013 Chicago alderman passed an ordinance on bed bug control.  The ordinance requires eradication to be performed by a pest control professional as many times as necessary to eliminate the reported problem.  Click here to read the full ordinance.  

The City of Chicago has recently been named the nation’s #1 city infested with bed bugs.  Everyday MTO’s tenants’ rights hotline receives calls from renters throughout the City and suburbs dealing with the pesky pests.  Bed bugs are not unique to Chicago.  They are undoubtedly a nuisance and hard to control.  Controlling bed bugs requires tenants and landlords working together. There are key components of the ordinance that all renters should know.  Let’s start with landlord responsibilities:

  • To supply a tenant starting or renewing a lease with an informational brochure
  • To maintain a written record of bed bug control efforts
  • To send a written notice to the tenant explaining their responsibilities before the inspection
  • To provide pest control services when bed bugs are found by a pest management professional as many times as necessary to eliminate the problem
  • To inspect within 10 days and treat if necessary the two units on either side as well as the two units above and below of the infested unit

The ordinance also outlines what tenants’ responsibilities are to help eliminate bed bugs.  Please note that this section of the ordinance does not apply to tenants living in assisted living or a shared housing establishment, when the establishment provides assistance with daily living activities.  According to the ordinance, tenant responsibilities include:

  • To notify the landlord in writing of any suspected or known infestation in the tenants’ unit, clothing, furniture or personal property within 5 days
  • To notify the landlord in writing of any recurring or unexplained bites, stings or sores suspected to be caused by bed bugs
  • To cooperate with the landlord in the control, treatment, and eradication of bed bugs including
  • To grant access at reasonable times upon reasonable notice for inspections and treatments/to not interfere
  • To prepare unit prior to treatment including:  cleaning, dusting, vacuuming
  • To properly dispose of personal property that cannot be treated or cleaned before the pest control services

The Chicago Bed Bug Ordinance also mandates the disposal of bedding, clothing, furnishings or other infested materials.  For example, you may not place, discard or dispose of any bedding, clothing or furnishings infested on the public way (i.e. dumpsters, sidewalks, hallways).  To get rid of infested items, you must enclose the item in a plastic bag and label it as infested.  Doing so should prevent neighbors from bringing to their home infested items, therefore stalling the spread of bed bugs.

The ordinance will be enforced by the Department of Buildings and the Department of Public Health.  If any person is found violating the ordinancethat person may be fined $300.00 to $1,000 per day for each offense.  By complying with the ordinance, these fees can be avoided.  

My landlord won’t accept responsibility. What should I do?

If you live in a building with 12 or more units and other renters in the building are living with bed bugs, you may also request a visit from an organizer who can assist you in getting your requests met by your landlord.

CHICAGO BUILDING CODE RE: PESTS

13-196-630  Residential buildings – Responsibilities of owner or operator.

Every owner or operator must:

(a)     Comply with the requirements imposed on him by this chapter;

(b)     Maintain in a clean, sanitary and safe condition the shared or public areas of the dwelling or premises, and maintain and repair any equipment of a type specified in this Code which he supplies or is required to supply;

(c)     Exterminate any insects, rodents or other pests in any family unit, if infestation is caused by the failure of the owner or operator to maintain the dwelling in a ratproof or reasonable insect-proof condition, and he must exterminate such pests in any family unit in the dwelling, regardless of the cause of infestation, if infestation exists in two or more of the family units in the dwelling or in the shared or public parts of any dwelling containing two or more family units; and

(d)     Supply and maintain the facilities for refuse disposal which are required of him by Section 7-28-220.

Asthma – FAQ

What is asthma?
Asthma is a chronic disease of the lungs that makes it very difficult to breathe. The small and medium airways swell and fill with mucus when they come into contact with certain environmental allergens. In some cases asthma can cause death. Asthma cannot be cured but it can be controlled through medications and cleaning up your environment.

What allergens found in the home can cause asthma?
Dust mites are a common allergen that can trigger an asthma attack. Dust mites can be found in carpets, drapes, overstuffed furniture and bedding and the result of poor air sealing of windows and doors can allow outside dust into the home.
Other common household hazards that can trigger asthma attacks are:
* Leaking plumbing and roofs; water damaged areas
* Poor ventilation in bathrooms and kitchens
* Basements and crawlspaces without proper drainage or moisture control
* Infestations of cockroaches, mice and rats can cause allergic reactions
* Extreme temperature shifts, either hot or cold, can trigger asthma attacks

Does the landlord have to provide heat and air-conditioning if I have asthma?
The landlord must provide heat from heat September 15 – June 1. The landlord must maintain the following minimum temperatures:
68 degrees from 8:30 am to 10:30 pm
66 degrees from 10:30 pm – 8:30 am
The landlord is not required to provide air-conditioning.

Indoor Air Quality & Smoking

The new Chicago Clean Indoor Air Ordinance was signed into law on Feb. 13, 2008 and supersedes the Smoke Free Illinois Act. The new law is intended to protect patrons and workers against the dangers of secondhand smoke.

As of February 13, 2008 smoking is prohibited in:

  • All enclosed workplaces;
  • All restaurants;
  • All bars;
  • All healthcare facilities;
  • Public places including government buildings, convention facilities, laundromats, public transportation facilities and shopping malls;
  • Public restrooms, lobbies, reception areas, hallways and other common use areas in public buildings, apartment buildings and condominium buildings;
  • Within 15 feet of the entrance to enclosed public places;
  • Recreational areas including enclosed sports arenas, stadiums, swimming pools, ice and roller rinks, arcades and bowling alleys; and
  • City government vehicles.

Regulations, Fines & Fees

The Department of Public Health and the Department of Business Affairs and Licensing will monitor compliance with the ordinance during routine inspections. The City will also respond to complaints made to 311. Individuals who are smoking in areas prohibited by the ordinance are guilty of an infraction punishable by fines of up to $250.

More About the New Ordinance

The updated Chicago Clean Indoor Air Ordinance was passed by the Chicago City Council in January 2008. It replaces current law, passed in December 2005 and supersedes the Smoke Free Illinois Act. The new law is intended to protect the health of patrons and workers against the dangers of tobacco smoke, including secondhand smoke. Secondhand smoke is known to cause cancer and heart disease, and “safe” levels of secondhand smoke have not been identified.

Lead – FAQ

Know the facts about lead:

  • What is lead? Lead is a heavy metal that is harmful to your health.
  • Where is lead found? The most common sources of lead are found in the home! Chipping paint and dust in homes built prior to 1978, tap water, soil and some toys and jewelry are the most common sources of lead. You can’t always see lead, even when it is present.
  • What amount of lead is safe? Lead in the body is not safe at ANY level.  It only takes a very small amount to cause life-long health problems, including learning disabilities, behavioral problems, and other health issues.
  • What are the long-term effects of lead poisoning? Lead can damage organs, stunt neurological development and may even cause death.
  • What are some of the warning signs of lead poisoning? Stomach pains, constipation, poor appetite, sleep problems, headaches, issues with sleeping.
  • How do I know if I have lead in my home? If your home was built prior to 1978, there is a good chance there is lead in your home but the only way to positively identify lead is with testing. The Department of Health offers free testing if your child has recently been found with elevated levels of lead.
  • Who’s responsible for addressing lead sources in the home? The landlord is responsible. Under federal law, at the start of a tenancy, the landlord must provide tenants with a lead disclosure form that details any known lead hazard in your unit or the common areas and a copy of the EPA booklet “Protect Your Family from Lead in your Home“. Under 2004 Childhood Lead Prevention Act, the landlord must also post a notice if a lead hazard has been found in another unit. That notice must remain posted until all documented hazards are properly repaired.
  • What if the landlord refuses to address lead sources? Call the Renter’s Hotline at 773-292-4988 M-F, 1-5pm or call the city of Chicago’s Childhood Lead Poisoning Prevention program at 312.747.LEAD[5323]. You may request an inspection. If the landlord refuses to make repairs and old paint is pulling away from the wall, cracking, chipping or peeling and it is a code violation, you can give the landlord a 14-day written notice to reduce your rent.   • What can I do to reduce the risk of exposure? 
    • Ask your doctor to test your child for lead
    • Regularly wet-mop floors and wet-wipe windows
    • Remove shoes when entering the home
    • Teach your children to wash their hands before eating
    • Do not use pottery for cooking or serving without knowing if the glaze has lead
    • Do not disturb paint without protecting your family from the dust
    • Feed your child a diet high in iron, calcium and vitamin C – all help fight lead in the child’s body
    • Test your water for lead and use a EPA approved filter
    • Test soil around home and do not plant a garden before confirming that soil is safe
    • Regularly check recall lists for toys, jewelry and other household items which may have lead

Mold – FAQ

You may not see mold, but you may smell something like this in the basement.

How do I know if I have mold in my apartment?
The basic rule is “if you can see mold or smell mold, you have mold.” There are no fancy tests needed to tell you what kind of mold you have. Any mold in your home or apartment is bad mold.

Can I withhold rent or use my rent to fix a mold problem?
Yes. See “Apartment Repairs and Conditions.” Mold grows on wet or damp surfaces. If mold exists in your apartment, it is important to fix any moisture problem first. Painting over mold does not get rid of the problem. Only after the moisture problem is fixed, should you paint.

Those black spots on the window sill are mold, most likely caused by condensation and old, drafty windows. The moisture problem on the windows at this home also loosened up so much paint that the child living here became lead poisoned.

Is my landlord responsible if my property is damaged by mold?
If you believe your property was damaged as a result of the negligence of the landlord, make a detailed list of all the property damaged and send the list to the landlord asking for compensation. If the landlord refuses to pay you will need to contact an attorney.
